Alaska Lawmaker Files Bill to Outlaw Abortion in State
ANCHORAGE, Ak. — A lawmaker in Alaska has introduced a bill that would outlaw abortion in the state, and would reject any rule or order that would conflict with the law, being seen as infringing upon the child’s constitutional right to life.
Rep. David Eastman, R-Wasilla, filed House Bill 178, also known as the “Abolition of Abortion Act,” on Wednesday. It defines a child as being a person “from the moment of conception until 18 years of age,” and notes that the Alaska Constitution declares that “all persons are equal and entitled to equal rights, opportunities, and protection under the law.”
“[T]he implementation of state law protecting the right to life of all persons is the constitutional responsibility of the legislative branch, not the judiciary,” the bill states, and clarifies that “it was never the intent of [the state Constitution’s right to privacy] or any other section of the Constitution of the State of Alaska, to recognize a right of any person to take the life of an innocent child.”
It further points to the 10th Amendment of the federal Constitution, which outlines that the powers not expressly granted to the federal government are reserved to the states.
Therefore, “a statute, regulation, rule, or order that has the purpose, intent, or effect of legalizing any abortion in the state infringes on a child’s right to life in violation of the Fourteenth Amendment to the Constitution of the United States … is not the supreme law of the land, and, consequently, is invalid in this state and shall be considered null and void and of no effect in this state.”
While the bill will not be considered until the 2020 legislative season, those who support abortion “rights” are already upset over the measure, including the co-chair of the House Health and Social Services Committee, where the bill has been assigned.
Rep. Ivy Spohnholz, D-Anchorage, told the Associated Press on Friday that she has “no interest in making it illegal for women to get an important health care procedure,” inferring that abortions are for “medical” reasons.
A rally led by organizations such as Planned Parenthood Votes and the Alaska American Civil Liberties Union (ACLU) was also held on Saturday in protest of the legislation, according to local television station KTUU. One speaker asserted that Eastman should “worry about [his] own body and [his] own choices.”
However, Eastman was not fazed by the opposition, but rather told reporters that he is glad that the bill has sparked conversation.
“I’m encouraged to see the discussion that has begun since the bill was filed,” he said. “This is a conversation that our state has been desperately needing to have for many years. At another time in our nation’s history there were large rallies and some even moved their entire families in an effort to keep slavery free and legal. Today’s rallies for the ‘choice’ to do what you want to those waiting to be born are no less inhumane. I stand with a child’s right to live.”
As previously reported, while some assert the right to “bodily autonomy” to argue in favor of keeping abortion legal, Scripture states in 1 Corinthians 6:19-20, “Know ye not that your body is the temple of the Holy Ghost which is in you, which ye have of God, and ye are not your own? For ye are bought with a price, therefore glorify God in your body and in your spirit, which are God’s.”
2 Corinthians 5:15 also teaches,”And He died for all that they which live should not henceforth live unto themselves, but unto Him which died for them and rose again.”
