DHS Revives Trump-Style Asylum Limits to Stop New Border Surge; Biden Unveils Trump-Style Plan to Deter Asylum Seekers at Mexico Border; Biden to Replace Trump Migration Policy with Trump-esque Asylum Policy
DHS revives Trump-style asylum limits to stop new border surge:
The Biden administration proposed rules Tuesday to block illegal immigrants from jumping the border to file bogus asylum claims, embracing a Trump-style policy that President Biden once labeled a “humanitarian disaster.”
Under the tighter proposed rules, those who cross through other nations to reach the U.S. border would be presumed ineligible for asylum. Instead, they would be encouraged to find legal pathways to enter the country.
The proposed policy amounts to an acknowledgment that as bad as the border situation is now, it could get worse when the administration shuts down the pandemic-related Title 42 border expulsion policy this spring.
Homeland Security Secretary Alejandro Mayorkas said the proposal is an attempt to channel the chaotic flow of illegal immigration into legal avenues.
“As we have seen time and time again, individuals who are provided a safe, orderly and lawful path to the United States are less likely to risk their lives traversing thousands of miles in the hands of ruthless smugglers, only to arrive at our southern border and face the legal consequences of unlawful entry,” he said.
His plan is likely to face legal challenges, becoming the latest of Mr. Biden’s immigration policies to wind up in court. —>READ MORE HERE
Biden unveils Trump-style plan to deter asylum seekers at Mexico border:
The United States could bar tens of thousands of migrants arriving at the US-Mexico border from claiming asylum under a proposal unveiled on Tuesday that would be the most wide-ranging attempt yet by Joe Biden’s administration to deter unauthorized crossings.
Under the new rules, the US would generally deny asylum to migrants who show up at the US southern border without first seeking protection in a country they passed through, mirroring an attempt by the Trump administration that never took effect because it was blocked in court.
The measure, while stopping short of a total ban, imposes severe limitations on asylum for people of any nationality except Mexicans, who don’t have to travel through a third country to reach the US.
The proposed rule establishes “a rebuttable presumption of asylum ineligibility” for anyone who passes through another country to reach the US border with Mexico without first seeking protection there, according to a notice in the Federal Register. Exceptions will be made for people with an “acute medical emergency”, “imminent and extreme threat” of violent crimes such as murder, rape or kidnapping, being a victim of human trafficking or “other extremely compelling circumstances”. Children traveling alone will also be exempted, according to the rule.
The measure, which was posted online on Tuesday, will be subject to a 30-day public comment period before it can be formally adopted. It would also be temporary and limited to a period of two years, with the possibility to extend it. —>READ MORE HERE
