GOP moves to block Biden’s pistol brace rule: ‘Abuse of rule-making authority’:

House Republicans this week will take a step toward blocking the Biden administration’s new rule that tightens regulations on pistol stabilizing braces, and call the rule an “abuse” of federal authority.

The rule, called Factoring Criteria for Firearms with Attached Stabilizing Braces, took effect on Jan. 31 after it was finalized by the Bureau of Alcohol, Firearms, Tobacco and Explosives (ATF). It will treat any firearms with stabilizing accessories as short-barreled rifles, which require a federal license to own under the National Firearms Act.

According to Republicans, the rule would require gun owners to either register pistols with stabilizing braces with the ATF, turn over those firearms, or face 10 years in jail and up to $10,000 in fines.

Reps. Andrew Clyde, R-Ga., and Richard Hudson, R-N.C., are leading the effort in the House of Representatives, and plan to introduce a Congressional Review Act (CRA) resolution on Monday. The resolution would nullify the Biden administration rule if passed by the House and Senate and signed by President Biden, or if Congress were to override a likely Biden veto.

“Congress must swiftly move to block the ATF’s unconstitutional pistol brace rule, as this misguided measure turns millions of law-abiding gun owners, including many disabled veterans, into criminals for merely possessing legal firearms with stabilizing braces,” Clyde told Fox News Digital ahead of the introduction of the measure —>READ MORE HERE

Republicans threaten to defund Biden gun rule that aims to reclassify pistols with braces as rifles:

Republican lawmakers vowed Tuesday to defund any attempt by the Biden administration to enforce a new gun control rule that would reclassify pistols with stabilizing braces as short-barreled rifles.

Under a new Bureau of Alcohol, Tobacco, Firearms and Explosives rule — “Factoring Criteria for Firearms with Attached Stabilizing Braces” — gun owners who have a stabilizing brace attachment on their firearm must register the device by May 31 or face up to 10 years in prison and thousands of dollars in fines.

But Republican House lawmakers, gathered in Orlando this week for their annual GOP retreat, are lining up behind an effort to block the administration — and one said there will be no money in the budget produced by the Republican-controlled House to enforce the rule, which took effect Jan. 31.

Rep. Andrew Clyde is pushing a resolution checking the administration, introduced almost a week ago, and already has 182 Republican cosponsors. He told The Washington Times that federal agencies are engaged in a power grab.

“The ATF has overstepped its bounds significantly. They’re not a legislative arm of the government,” the Georgia Republican said.

“They’re an executive arm. And when they legislate, which is what they’re doing, redefining a definition, then they have exceeded their authority.” —>READ MORE HERE
