South Africa exploiting ICJ to strengthen Hamas militarily — Israel warns
South Africa is exploiting the International Court of Justice to help Hamas gain the upper military edge over the IDF in the Gaza war, Israel’s Deputy Attorney General Gilad Noam told the court at The Hauge on Friday.
He spoke at a hearing on South Africa’s demand that the ICJ order Israel to halt its military activity in Gaza, in a situation where no such binding demand can be made on Hamas.
Israel appeared before the court as part of a case it is defending itself against South Africa’s claim that it is in violation of the 1948 Genocide Convention over its actions against Hamas in Gaza. Noam noted that while Israel was a party to the convention, Hamas was not and that, therefore, any ICJ order that would halt Israel’s actions would allow Hamas to continue to attack Israel.

South Africa, he said, turned to the court “in order to obtain military advantage for its ally Hamas, which it does not wish to see defeated.”
He noted that South Africa hosted a Hamas delegation in Johannesburg only six days before it submitted its latest request to the court for provisional measures.
“They did not use the meeting to urge Hamas to release the hostages, to stop targeting Israeli civilians, to cease using human shields, to cease operating from within and nearby hospitals, UN facilities, and other protected sites,” he said.
They apparently met, he charged, to discuss their continued campaign against Israel in the court and on the ground.
